ఫీజుల కోసం Certificates ఆపడం చెల్లదు.. తెలంగాణ హైకోర్టు సంచలన తీర్పు
ఫీజులు బాకీ ఉన్నారనే నెపంతో విద్యార్థుల ఒరిజినల్ Certificates నిలిపివేయడం చట్ట విరుద్ధమని తెలంగాణ హైకోర్టు స్పష్టం చేసింది. విద్యార్థి సమర్పించిన ధృవీకరణ పత్రాలు వారి వ్యక్తిగత ఆస్తి అని, వాటిని ఆపే హక్కు విద్యా సంస్థలకు లేదని కోర్టు తేల్చి చెప్పింది. ఫీజు బకాయిలు ఉంటే వాటిని వసూలు చేయడానికి చట్టబద్ధమైన ఇతర మార్గాలను అనుసరించాలి తప్ప, విద్యార్థి భవిష్యత్తును ఇబ్బందుల్లోకి నెట్టేలా సర్టిఫికెట్లను వాడుకోకూడదని జస్టిస్ జువ్వాడి శ్రీదేవి నేతృత్వంలోని బెంచ్ ఈ కీలక ఉత్తర్వులను జారీ చేసింది.
ఖమ్మం జిల్లాకు చెందిన ఒక విద్యార్థి హైదరాబాద్లోని సిద్ధార్థ ఇన్స్టిట్యూట్ ఆఫ్ టెక్నాలజీ అండ్ సైన్సెస్ యాజమాన్యంపై దాఖలు చేసిన పిటిషన్పై విచారణ సందర్భంగా ఈ తీర్పు వెలువడింది. కాలేజీలో జరిగిన గొడవ కారణంగా చదువు మానేసిన సదరు విద్యార్థి, తన సర్టిఫికెట్ల కోసం వెళ్లగా మిగిలిన మూడేళ్ల ఫీజు చెల్లించాలని యాజమాన్యం వేధించినట్లు కోర్టు దృష్టికి వచ్చింది. దీనిని తీవ్రంగా పరిగణించిన హైకోర్టు, వెంటనే విద్యార్థి పత్రాలను తిరిగి ఇచ్చేయాలని సదరు కాలేజీని ఆదేశించింది.
విద్యార్థి హక్కులపై హైకోర్టు స్పష్టత
చాలా ప్రైవేట్ విద్యా సంస్థలు ఫీజుల వసూళ్ల కోసం విద్యార్థుల సర్టిఫికెట్లను పూచీకత్తుగా ఉంచుకుంటున్నాయని, ఇది అన్యాయమని కోర్టు పేర్కొంది. విద్యార్థికి ఉద్యోగ అవకాశాలు లేదా ఉన్నత చదువుల కోసం ఈ పత్రాలు అత్యవసరమని, వాటిని ఆపడం వల్ల వారి కెరీర్ దెబ్బతింటుందని ధర్మాసనం అభిప్రాయపడింది. ఈ తీర్పుతో రాష్ట్రంలోని వేలాది మంది విద్యార్థులకు ఊరట లభించనుంది.
సర్టిఫికెట్లు విద్యార్థి వ్యక్తిగత ఆస్తి
విద్యాసంస్థలు విద్యార్థుల పత్రాలను కేవలం పరిశీలన కోసం మాత్రమే తీసుకోవాలని, వాటిని ఫీజు రికవరీ కోసం వాడుకోకూడదని న్యాయమూర్తి పేర్కొన్నారు. అడ్మిషన్ సమయంలో తీసుకున్న SSC, ఇంటర్ మెమోలు, టీసీ వంటి ఒరిజినల్ పత్రాలను విద్యార్థి ఎప్పుడు కోరినా తిరిగి ఇచ్చేయాలని స్పష్టం చేశారు. ఈ తీర్పు రాష్ట్రవ్యాప్తంగా సర్టిఫికెట్ల సమస్యను ఎదుర్కొంటున్న వేలాది మంది విద్యార్థులకు పెద్ద ఊరటగా మారింది.
The Telangana High Court has delivered a landmark judgment stating that private colleges cannot withhold students’ original Certificates under the pretext of pending fee dues. The court emphasized that the original documents submitted by a student are their personal property. Justice Juvvadi Sridevi, presiding over the case, directed an engineering college to immediately return the certificates to a petitioner who had discontinued his studies.
The petitioner had approached the court after the college management demanded fees for the remaining three years of his course to return his SSC, Inter memos, and TC. The court observed that while colleges have the right to collect dues, they must do so through legal channels rather than holding essential documents hostage. This ruling serves as a stern warning to educational institutions that prioritize fee collection over student welfare and legal rights.
